What is a Notary Acknowledgment?

A notary acknowledgment is one of the most common notarizations. It is a legal form signed by a notary public which officially states that:

• A signer has appeared before them.
• The signer has provided the necessary documentation to prove their identity.
• The signer confirms that they are signing the documents willingly.

What is a Jurat and How Does It Differ?

A jurat is another common notarization. Similar to an acknowledgment, a jurat must be signed in the presence of a notary public. A jurat allows the signer to affirm or swear to the truthfulness of the document being signed. Jurats are also required for different kinds of documents than acknowledgments, usually legal statements such as affidavits or depositions.

Before a jurat can be notarized, the signer must verbally affirm or take an oath in the presence of the notary public before signing it. Even though acknowledgments and jurats are similar, double-check which form you need before meeting with a notary. In Texas, the exact certificate wording of these notarizations must be correct and cannot be used interchangeably.

The Signature Process

• Your notary will need identification to verify who you are. Texas often requires ID as satisfactory evidence of the signer's presence and intent.
• You need to show you have either signed the document beforehand, or you can sign in the notary's presence, with a credible witness.
• Finally, your notary must sign an acknowledgment form, stating that you were willing to do so.

In Texas, notaries must meet with the person or persons who are to sign the document. Online notarization services are not valid in cases where your notary must provide a Texas notary acknowledgment. These must be done in person.
